Breckenridge Short Term Rental Zoning Information

Are you considering getting into the Breckenridge Real Estate market and intend on short-term renting your property? Let’s discuss the ins and outs of what the Breckenridge Town Council has implemented.

In the fall of 2021, the Breckenridge Town Council passed an ordinance capping the number of short-term rental licenses to 2,200. This did not include properties they considered resort or hotel properties. That essentially halted any new short-term rental licenses being issued. In August 2022, after consulting with the Tourism Overlay Task Force, the Breckenridge Town Council passed a new ordinance that there will now be 4 areas/zones, each with its own restriction on the number of short-term rentals allowed. This new zoning will go into place on September 27, 2022.

Resort Properties Zone

In the Breckenridge Resort Properties Zone, all condo owners are able to apply for a short-term rental license; there are no restrictions in this zone. Here are the complexes in the Resort Properties Zone:

Downtown Core (Zone 2)

The Downtown Core, also known as Zone 2, is just like it sounds, the areas including and surrounding downtown/Main Street Breckenridge. This zone only has 257 units and limits short-term rental licenses to 51% (130 units). For a list of these subdivisions, please contact us directly.

Single Family Residential Areas (Zone 3)

The final zone is the Single Family Residential Areas, also known as Zone 3, which comprises all the remaining areas of Breckenridge that have not been previously mentioned. There are just over 100 subdivisions in Zone 3, and only 10% are allowed to obtain rental licenses. Currently, the number of rental licenses in Zone 3 is well over the limit at 1,223 of the 390 allowed. What this means is that if you purchase in Zone 3, you can place your property on the wait list until the number of licenses drops to under the 390 mark. Please contact us for this list as well.
